Mr. Lipscomb, from North Carolina, was in NYC for a baby shower the evening that Delrawn Small was killed. Mr Lipscomb testified that he had stepped outside and was on the phone when he heard arguing and then gunshots. He watched Delrawn Small stagger and fall after being shot. He saw Wayne Isaacs get out of his car, walk slightly toward Mr. Small and then walk away - not giving any aid.
Zanaia Isaacs, Delrawn Small's 15 year old stepdaughter was with Mr. Small the night he was killed. She took the stand and testified about the sequence of events. Zanaia was the person who called 911 for her stepfather, Delrawn Small, after she heard and saw him being shot. She testified that after Delrawn Small was shot, she saw Wayne Isaacs holding his gun outside his car door. She saw her stepfather struggling on the ground after being shot. She saw Wayne Isaacs exit his car, and then walk back towards his car. The emotional 911 call that Zanaia made was played for the jurors.
NYPD Detective Raymond Damora testified to being part of the Crime Scene Investigation Unit that processed Wayne Isaacs car. Casings for 1 of the 3 bullets Wayne Isaacs fired was not initially found at the scene. It was only found after the car was processed, the driver's seat was removed, and it was located underneath the cut of the car rug.
NYPD Lieutenant Celikov, from the 75th precinct testified to being called to the scene based on 2 radio calls. The first radio call was a report that an assault was in progress. The second radio call, soon after, was called in as "officer needs assistance". Lieutenant Celikov was the officer who took and inspected Wayne Isaacs' gun while at the scene. He also stated that he did not put Wayne Isaacs under arrest.
